Rules of the "Your Opinion Matters" competition

(hereinafter referred to as the "Competition"),

1. Organiser

The organizer of the competition is Pola Fashion s r. o., company ID 04717473, with registered office at Na Vyhlídce 2582, 738 01 Frýdek-Místek, registered at the Regional Court in Ostrava, Section C, Insert 64874, e-mail: info@polacosmetics.cz (hereinafter referred to as the "organizer").

2. Time and place of the competition

2.1 The competition will run from 1 January 2024 at 00:00.

2.2 The competition will be held exclusively in the Czech Republic and will be published on the organiser's website www.polacosmetics.cz.

3. Conditions of participation in the competition

The competition is open to any natural person who is 18 years of age or older at the time of the competition and who is legally competent within the meaning of the relevant provisions of Act No. 89/2012 Coll, Civil Code, as amended (hereinafter referred to as "Civil Code") and has a valid address for delivery in the Czech Republic, provided that he/she meets the conditions of the competition set out in these Rules and agrees to these Rules (hereinafter referred to as "Contestant" or "Contest Participant" or "Winner"). Each Contestant who enters the competition is solely responsible for complying with all the conditions of the competition set out in these Rules. A Contestant may only enter one review per product purchased at any one time; if a Contestant has purchased multiple products, the Contestant may enter the Contest repeatedly (within one review for each product purchased). Employees of the organizer, business partners and persons close to these persons within the meaning of the relevant provisions of the Civil Code may not participate in the competition. In the event that any of the terms and conditions of this Competition are not fulfilled by the entrants, the Promoter shall be entitled to exercise its rights under clauses 6.5 to 6.7 of these Rules.

4. Contest progress, drawing of the winner

4.1 The Contestant may enter the Contest solely by purchasing goods from the Promoter, by submitting an evaluation in accordance with the Promoter's Terms and Conditions and by expressing an interest in participating in the Contest, including agreeing to these Rules. By confirming his/her consent, each Contestant simultaneously declares and confirms that he/she meets the conditions for participation in the Contest and agrees to the Contest Rules. There is no fee for participation in the Contest.

4.2 Ratings that contravene the "Terms and Conditions of Customer Ratings and Reviews" will not be published and the Promoter reserves the right to exclude such ratings from the Competition.

4.3.The draw and the announcement of the winners will take place at the organiser's headquarters, on a continuous basis, on the dates listed below each month, from all contestants who have fulfilled the conditions of the competition in the previous month - or have added one rating of the organiser's product on the www.polacosmetics.cz website in accordance with the conditions of the competition. One contestant can win a maximum of one prize. One winner will be drawn in each draw.

4.4 Following the draw, winners will be contacted directly by the Promoter within 7 working days of the draw via email to the email address they provided in their product review. In the event that the Winner does not respond to such email notifying the Promoter of the prize and fails to provide the Promoter with their email contact details within the 7 calendar day period, the Winner's entitlement to the prize shall cease and the prize shall remain with the Promoter, who reserves the right to draw an alternative winner in such event, but the Promoter may not exercise such right. The Promoter shall be entitled to follow the same procedure in the event that the winner waives his/her right to the prize.

5. Winning

Within one draw (once a month) 1 prize will be drawn - 1 product that has been rated by the contestant.

6. Rights of the organiser and the competition organiser

6.1 The liability of the organiser and the competition organiser for any defects in the prize is governed by the relevant provisions of Act No. 89/2012 Coll., the Civil Code.

6.2 The Competition Organiser reserves the right to change the Competition Rules, shorten, extend or terminate the Competition at any time during the duration of the Competition without compensation.

6.3.The Promoter reserves the right to substitute the prize specified in these Rules with a prize of similar type and value in the event that for objective reasons not attributable to the Promoter it is not possible to obtain or deliver the prize without unreasonable effort.

6.4 The results of the competition are final, with no possibility of appeal. The prizes in kind cannot be paid in cash or other compensation. Neither the participation in the competition nor the prizes can be enforced by legal action. The final decision on disputed issues is always at the sole discretion of the competition organiser.

6.5 Persons who do not meet the conditions for participation in the competition or who act in violation of the Rules of this competition (see point 3. of the Rules) will not be included in the competition or may be excluded from the competition, thereby losing their right to further participation in the competition and to any prize, which will be forfeited to the organizer (hereinafter also referred to as "ineligible contestant" or "ineligible winner"). If it turns out that this person has become a winner despite the aforementioned facts, the prize will not be handed over to him/her, but if it has already been handed over, it is considered to be unjust enrichment of the unauthorised winner according to the relevant provisions of the Civil Code. The unauthorised winner is obliged to return the object of unjust enrichment to the organiser without delay. In this case, the organizer reserves the right to draw an alternative winner, but the organizer is not obliged to exercise such right.

6.6.In view of the above, the Promoter reserves the right to exclude an ineligible entrant from the competition (and consequently not to issue a prize to an ineligible winner) in the event of:

(a) multiple entries in the competition when a competitor purchases only one product (e.g. by adding more than one rating to one product purchased)

b) the involvement of an employee of the organiser or a person close to the organiser

c) where the Promoter discovers or has reasonable suspicion of fraudulent or unfair conduct on the part of any of the entrants or any other person who has assisted the entrant in obtaining the prize, or conduct that is not fair play or not based on the entrant's skills under the Competition Rules

6.7 The Promoter reserves the right to verify the eligibility of the Contestant to participate in the Contest, and consequently the Winner for the evaluation of the Contest in accordance with these Rules (e.g. by presenting the Contestant's identity document).

6.8 The Promoter shall not reimburse any costs to the competitors or any other obligations they may incur as a result of their participation in the competition or in connection with winning the competition.

7. Protection and processing of personal data

7.1 By participating in the Competition, the Participant expresses his/her compliance with Regulation (EU) No. 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, as in force from 25 May 2018 (hereinafter referred to as the "Regulation") and Act No. 110/2019 Coll, on the processing of personal data, as amended, consent to the processing of personal data (hereinafter referred to as "personal data") provided by the contestant to the organizer in the context of participation in the competition, in the following scope: address, name, surname, contact address, contact tel. The personal data provided by each contestant to the organizer in the context of participation in the competition will be used by the organizer exclusively for the purpose of the competition (sending the prize, or verifying the age of the contestant, announcing the winner on the website www.The personal data provided will be stored by the organizer in the case of the winner for 36 months from the moment of the prize submission, after which it will be deleted in accordance with the relevant legislation.

7.2 However, no further participation in the Competition is possible after the withdrawal of consent. The Organizer hereby informs the Contestant that the provision of personal data by the Contestant is voluntary. The Contestant who has provided personal data is responsible for ensuring that the personal data provided is correct, complete, up-to-date and true and is entitled to provide it to the Promoter for processing in accordance with the Regulation. By participating in the competition, the contestant confirms that he/she is aware of all the necessary information under the Regulation, in particular the identification data of the organiser as the controller, the purpose of the processing of personal data (the implementation of the competition), the list of personal data processed (address, name, surname, contact address, e-mail and contact telephone number), that he/she has been informed of the voluntary nature of the provision of personal data, the period of validity of the consent given, as well as the fact that he/she has been informed of his/her rights as a data subject within the meaning of the Regulation (the above information is available on the organiser's website www.By participating in the competition, the contestant also agrees to the gratuitous publication of personal data in the media, namely on the Internet, in the event that he/she becomes the winner of the prize. The data provided by the contestant may be processed electronically. The competition organiser is the controller within the meaning of the Regulation. A contestant who has provided personal data to the organiser has the right of access to the personal data (Article 15(1) of the Regulation), i.e. the right to request free information about the personal data processed about him/her by the organiser and other rights under the Regulation if, for example, he/she finds that the organiser is in breach of its obligations under the above Regulation, and the right to request the rectification of inaccurate personal data (Article 15(1) of the Regulation). 16 of the Regulation), as well as the right to erasure of personal data (Article 17 of the Regulation) and to restriction of the processing of personal data (Article 18 of the Regulation) by the organiser, who will comply with the relevant legislation (including the regulations on archives and archivists). If you have provided the personal data being processed yourself, you have the right to data portability under Article 20 of the Regulation.

7.3 In the above cases or in the event of questions or complaints, any competitor may contact the Data Protection Officer in writing or by email. If you suspect that the processing of your personal data concerning you is in breach of the Regulation or that your rights have been violated in the processing of personal data, you may submit a petition to the Office for Personal Data Protection of the Czech Republic to initiate data protection proceedings.

7.4 You may contact the Promoter's Data Protection Officer electronically at info@polacosmetics.cz or in writing at the address of the Company's registered office set out in Clause 1 of these Rules.

In order to process personal data securely and to ensure that the processing complies with the Regulation and the Personal Data Processing Act, a responsible person supervises the processing.

8. Final Provisions

The Promoter is not liable for any damages incurred by the winner as a result of the prizes received.
